4. Audiovisual Media Services Directive

This Directive updates the 1997 ‘Television without Frontiers’ Directive and sets new EU rules on TV advertising and product placement. The rules must be included in the national law of EU countries by end 2009 and be monitored by independent regulatory bodies. Member States are to:

  • Encourage media service providers to develop codes of conduct to restrict inappropriate marketing of ‘junk’ foods and beverages in children's programmes.
  • Only allow product placement in TV programmes for commercial purposes if a signal alerts viewers at the start and end of the programme. Currently illegal in most of the EU, commercial product placement is still prohibited for news, current affairs and children's programmes and can still be completely banned by Member States.
  • Continue to limit TV ads to a max. of 12 minutes per hour (more allowed for TV news and films).
