10. House approves Do-Not-Call Improvement legislation

Two bills passed by the House of Representatives HR 3541, the Do-Not-Call Improvement Act, will eliminate the automatic removal of telephone numbers from the National Do-Not-Call (DNC) Registry. The Do-Not-Call Registry Fee Extension Act, authorises the FTC (Federal Trade Commission) to continue collecting fees relating to the operations of the DNC Registry. In almost five years of enforcing the Registry, the FTC has initiated 27 cases against violators, which have resulted in a total of $8.8 million in civil penalties and $8.6 million in redress. If approved by the US Senate, this legislation will require the FTC to report to Congress within nine months on efforts to improve the effectiveness and accuracy of the Registry. Since legitimate survey and opinion research is outside the scope of the DNC registry, these bills would have no direct impact on the profession. Australia and Canada have enacted similar legislation and have likewise targeted telemarketing calls only, excluding survey and opinion research calls.
